4.8 Where advertised as available, gift packaging and gift messages options are subject to the terms and conditions that govern those services. You agree not to send personal gift card messages with content that is threatening, embarrassing, abusive, harassing, obscene, hateful or otherwise inappropriate.
.1 You may change your mind about and cancel any order purchased from us online at any time from the date on which we email you to confirm that the order has been dispatched until twenty eighth (28) calendar days after you receive the product. For example: if we provide you with a dispatch confirmation email on 1 January and you receive the product on 10 January, you may cancel at any time between 1 January and the end of the day on 7 February.
5.2 This does not apply to products which:
(a) are not suitable for return due to health protection or hygiene reasons.
(b) become unsealed after delivery (e.g. for perfume, if the sealed packaging has been opened).
(c) have been clearly personalised (such as by being engraved).
(d) by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly. This doesn't affect your statutory rights if goods are faulty or not as described.
Online Returns: To return orders purchased from YSLBeauty.co.uk, you can use our free return service with RM, within 28 days of the receipt of your order.

5.4 If you have received your product before you changed your mind you must return it to us unopened and unsealed without undue delay (and in the meanwhile retain possession of the product and take reasonable care of them) using our online returns form in accordance with our returns policy
5.6 If you fail to return any product the direct cost of recovery of that product by us shall be borne by you. You shall assume all reasonable risks linked to the return of product(s).
Receiving a refund for your orders when you change your mind
5.8 Where the full order is returned undamaged and unused, we will refund any delivery costs you have paid to receive the product from us (except for the supplementary costs arising if you choose a type of delivery other than our standard and least expensive method of delivery).
5.9 We will make any refunds due to you as soon as possible and in any event within the deadlines indicated below:
(a) if you have received your product and decided to return back to us: 28 days after the day on which we receive the product back from you or, if earlier, the day on which you provide us with evidence that you have sent the product back to us.
(b) if you have not received the product or you have received it and decided to return to us: 28 days after you inform us of your decision to cancel the Contract.
Returning a product because it has a fault or is not as described
5.10 As a consumer, you have legal rights in relation to products that are faulty or not as described. These legal rights are not affected by your right of return and refund in this clause or anything else in the Terms. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office.
5.11 If you have returned the product to us because they are faulty or not as described, we will examine the product as quickly as possible. If the non-compliant nature of the product is confirmed by us, we will refund the price of the product in full, together with any applicable delivery charges
5.12 We will refund you using the same means of payment you used for the initial transaction, unless expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the products back or you have supplied evidence of having sent back the products, whichever is earliest.
6.1 The prices of the products are given in pounds sterling and are inclusive of VAT. We use our best efforts to ensure that the prices of the products are correct at the time of completing an order.
6.2 The final price payable by you for the product will be the price indicated on the page that is shown to you immediately before you place your order on the Website and in your order dispatch confirmation email.
6.3 We accept payment with MasterCard, VISA, and Maestro debit cards. All payments must be made at the time when the order is placed. Your credit or debit card will be charged when your order is ready for dispatch.

7.2 Delivery problems:
(a) We will not be liable or responsible if your delivery is affected by an event outside our control including in the event of overly long delivery time caused by the transportation services, and in the event of the loss of the products ordered. If a delivery is late, you must inform the Urban Decay Customer Services team as soon as possible, by e-mail sent to [email protected]. We shall then contact its chosen carrier in order to initiate an enquiry. Enquiries may take some time.
(b) Upon receipt of products ordered, you must check that products are compliant. Any delivery anomalies (missing or broken products, parcel damaged, etc.) must be noted by you on the form presented to you when the parcel is delivered and must be notified to the Urban Decay Customer Services team, on the returns form provided or by e-mail sent to [email protected], specifying which product does not match the order.
(c) If we miss the estimated delivery time for any products then you may cancel your order immediately if any of the following apply:
(i) we have refused to deliver the products;
(ii) delivery within the estimated time was essential (taking into account all the relevant circumstances); and
(iii) you communicated this to us before we accepted your order.
(d) If we miss the estimated delivery time for any products and you do not wish to cancel your order immediately, or do not have the right to do so, you can give us a new time for delivery, which must be reasonable, and you can cancel your order if we do not meet the new time.
(e) If you do choose to cancel your order for late delivery you can do so for just some of the products or all of them, unless splitting them up would significantly reduce their value. If the products have been delivered to you, you will have to return them to us, and we will pay the reasonable costs of this, subject to inclusion of an applicable returns delivery receipt. After you cancel your order we will refund any sums you have paid to us for the cancelled products and their delivery.
8.1 Personal data provided to or collected by us through this Website will only be used in accordance with our Privacy Policy. Please read this carefully before placing orders for products via our Website.
9.1 We are responsible to you for foreseeable loss and damaged caused by us. If we fail to comply with our obligations under these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of us breaking this Contract, or our failure to use reasonable care and skill. We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.
9.2 Nothing in these Terms of Sale shall limit or exclude our liability (i) for death or personal injury caused by our negligence or (ii) fraudulent misrepresentation or (iii) any other liability which cannot be excluded or limited under applicable law.
9.3 Nothing in these Terms of Sale affects your statutory rights as a consumer including your statutory rights relating to faulty or misdescribed goods. For further information about your statutory rights in the UK, contact your local authority Trading Standards Department or Citizen’s Advice Bureau.
10.1 If our supply of the products is delayed by an event outside of our control then we will contact you as soon as possible to let you know that a delay may occur, and we will take steps to minimise the effect of the delay. We will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products for which you have paid for but have not received.
11.1 We may update these Terms from time to time, for example to reflect changes in the law or to meet regulatory requirements, and reserve the right to do so at any time without any prior written notice to you. Your continued use of the Website subsequent to the posting of changes or updates shall mean that you accept and agree to the revisions, but we recommend that every time you order products from the Website that you check these Terms to ensure you understand the terms which will apply at that time which will apply to the Contract between us.

Please read these terms and conditions which govern your participation in the NFT Offer carefully. By participating, you unconditionally accept and agree to these terms and conditions and any decision reached by the Organizer or the Local Organizer, which is final and binding in all matters related to the NFT Offer as well as all applicable laws and regulations, including without limitation those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.

ARTICLE 1: SCOPE DURATION AND TERRITORY
1.1. Scope:
For this NFT Offer, the Organizer will allocate ("drop") a limited number of NFTs to participating customers as further detailed in Article 3.
This NFT Offer allows a customer to participate in a random allocation process for the NFTs as detailed in Article 2.2 below ("Allocation Process") which, if successful, gives that customer the right to:
• redeem the NFT allocated to the customer (as detailed in Article 3 below); and
• receive certain exclusive rewards (as detailed in Article 3).
In addition, each NFT Owner may also have the right to become part of the Yves Saint Laurent Beauté membership program and have access to additional rewards to those set out in Article 3 when purchasing specific items identified by the Organizer as may be made available from time to time by the Organizer in accordance with the terms and conditions available on the YSL Web3 Website.
1.2. Duration:
The NFT Offer shall take place from 10:00 on 31st January 2023 to 23:59 on 30th June 2023 (UK times) (the “Promotion Period”).
1.3. Territory:
This NFT Offer is open exclusively to customers purchasing a Black Opium fragrance from the following YSL Beauty e-commerce Local Websites: in the United Kingdom (https://www.yslbeauty.co.uk/), in the United States of America (https://www.yslbeautyus.com/), in France (https://www.yslbeauty.fr/) and in Australia (https://www.yslbeauty.com.au/).
ARTICLE 2: TERMS OF PARTICIPATION
2.1. NFT Offer participation requirements
2.1.1. The NFT Offer shall be open exclusively to customers who are 18 years of age or older. For this purpose, customers may be required to provide a valid identification document.
2.1.2. To participate in the NFT Offer, customers must purchase one or more products of eligible Black Opium fragrance on the Local Website during the Promotion Period. The list of eligible Black Opium fragrances is as follows: Black Opium Eau de Toilette, Black Opium Eau de Parfum, Black Opium Eau de Parfum Extrême, Black Opium Eau de Parfum Illicit Green, Black Opium Eau de Parfum Neon, Black Opium Eau de Parfum Intense, Black Opium Le Parfum in 30ml, 50ml, 75ml and 90ml (each order shall be considered a “Qualifying Purchase”). Each Qualifying Purchase will correspond to a unique entry right in the Allocation Process.
2.1.3. Any attempted fraud or abuse shall immediately disqualify the relevant customer from the NFT Offer and Allocation Process. Authorized participation in the NFT Offer or Allocation Process may be verified via various technical means available to the Organizer.
2.2. Allocation Process
2.2.1. In order to participate in the Allocation Process, customers meeting the participation requirements set out at Article 2.1 above shall complete the following steps:
1) Purchase a Qualifying Purchase on www.yslbeauty.co.uk during the Promotion Period; and
2) If the customer has not downloaded the YSL Beauty Wallet app, claim their unique entry right to receive an NFT, by clicking on the link available on the email sent by the Local Organizer to the customer post-purchase of a Qualifying Purchase. The link will allow the user to download the YSL Beauty Wallet app, on which they will be able to “claim ownership of the NFT”, if available. If the customer has previously downloaded the YSL Beauty Wallet app, no download will be required and they will be able to “claim ownership of the NFT”, if available, as above.
2.2.2. Due to the fact that the number of NFTs to be allocated to customers in the UK is limited, the Allocation Process will be based on a “first come, first served” basis. The type of NFT allocated to a NFT Owner is completely random.
2.3 NFT redemption
Redemption of any NFT allocated to a customer shall take place on the YSL Beauty Wallet app. Redemption of the rewards unlocked by the NFT shall also take place on the YSL Beauty Wallet app. Customers will need to download the YSL Beauty Wallet app to participate in this NFT Offer.
ARTICLE 3: NFT DROP DETAILS AND REWARDS
3.1. NFT editions: There are two (2) different designs linked to the Yves Saint Laurent Black Opium universe:
3.1.1. NFT #01: YSL Beauty Night Block - the original edition; and
3.1.2. NFT #02: YSL Beauty Night Block – the rare edition.
3.2. Under this NFT Offer, a total of 2,014 NFTs will be made available throughout the UK, US, France and Australia, as follows:
3.2.1. UK: Total NFTs 282 - of which NFT #01: 280 and NFT #02: 2
3.2.2. France: Total NFTs 181 - of which NFT #01: 180 and NFT #02: 1

NFT Owners of NFT #02 shall receive their Yves Saint Laurent Beauty customised set by post within 3 months of having communicated their desired delivery address by completing a dedicated form, provided that the Organiser will only deliver the set to an address in the United Kingdom. All other rewards will be provided via the YSL Beauty Wallet app.
ARTICLE 4: PERSONAL DATA
The Organizer and the Local Organizer each act as independent data controllers of personal data relating to participants in the NFT Offer, depending on the data being collected and what that data is being used for. Generally, the Local Organizer will be the controller of personal data collected and processed when the customer makes a Qualifying Purchase and when the customer receives the post-purchase email containing the link that will allow the customer to download the YSL Beauty Wallet app and participate in the Allocation Process. The Organizer will be the controller of personal data collected and processed through the claim page and the YSL Beauty Wallet app, including for the purposes of providing the customer with any NFT rewards that the customer redeems via the YSL Beauty Wallet app.

ARTICLE 5: LIABILITY
5.1. If the Organizer and/or the Local Organizer fail to comply with these terms and conditions:
5.1.1. the Local Organizer is responsible for loss or damage the customer suffers that is a foreseeable result of breach of these terms and conditions or negligence in relation to the post-purchase email sent to purchasers of a Qualifying Purchase, including, amongst other details, the link to participate to the Allocation Process; and
5.1.2. the Organizer is responsible for loss or damage the customer suffers that is a foreseeable result of breach of these terms and conditions or negligence in relation to all other obligations relating to this NFT Offer concerning the YSL Beauty Wallet app and the Allocation Process and provision of any NFT rewards;
but neither the Organiser nor the Local Organiser shall be responsible for any loss or damage that is not foreseeable.
Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by the customer and the Organizer or the Local Organizer at the time these terms and conditions were entered into.
5.2. The Organizer or the Local Organizer do not in any way exclude or limit their liability for: death or personal injury caused by their negligence; fraud or fraudulent misrepresentation; or any breach of the customer's statutory rights.
ARTICLE 6: AMENDMENT TO THE NFT OFFER AND THESE TERMS
6.1. The Organizer and the Local Organizer reserve the right to make the following changes to the NFT Offer at their sole discretion:
6.1.1. to reflect changes in relevant laws and regulatory requirements; or
6.1.2. to make minor technical adjustments and improvements, for example to address a security threat.
6.2. The Organizer and the Local Organizer reserve the right, in their absolute discretion, to vary these terms and conditions or suspend or cancel the promotion at any stage in the event of circumstances arising that are unforeseen or beyond their reasonable control (including suspected or actual fraudulent or misleading practices or other breaches of these terms and conditions). In these circumstances the Organizer and the Local Organizer reserve the right to postpone, shorten, extend, modify, cancel, or suspend the NFT Offer. In such case, the Organizer shall inform you promptly via notification sent through the YSL Beauty Wallet app and/or the Local Organizer shall inform you via email. Any change shall be reflected in these terms and conditions.
ARTICLE 7: COMPLAINTS AND REDRESS MECHANISM
7.1 Complaints. Our Customer Services Team will do their best to resolve any problems you have with us or the NFT Offer – they are available Monday through Friday from 9am to 5:30pm and Saturday from 9am to 12pm and can be contacted by telephone at 0800 917 1847 or by email at [email protected].
7.2 Resolving disputes without going to court. Alternative dispute resolution is an optional process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. ARTICLE 8: GOVERNING LAW AND JURISDICTION
These terms and conditions shall be governed by English law and wherever you live you can bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in.
